  EU SOCIAL DIALOGUE IN THE SPOTLIGHT

The social dialogue between EU-level organisations representing employers and trade unions can often seem remote from the everyday concerns of industrial relations and HR practitioners, but it has an increasingly significant and pervasive role in EU policymaking and in laying down Europe-wide guidelines and standards.

This issue of European Employment Review provides numerous examples of the social dialogue's growing importance. At central level, the "cross-industry" social partners reached a "historic" deal in October that will feed into new EU-wide "flexicurity" principles that the European Council is due to adopt in December. In the same month, they were consulted by the European Commission and given an opportunity to negotiate EU-level agreements on the "active inclusion of people furthest from the labour market" and on possibly reversing the current exclusion of maritime workers from many employment law Directives.

At the level of individual sectors, contract catering has just become the 35th industry to get an EU sectoral social dialogue committee, giving unions and employers a direct formal input into EU policies affecting them. Meanwhile, the social partners in the automotive sector have agreed a ground-breaking "European partnership for the anticipation of change", setting out a range of joint measures and policies aimed at improving competitiveness and employment in this ailing industry.

EU Council: Governments approve 'reform Treaty'

At an informal European Council summit on 18-19 October 2007, European Union heads of state and government approved the text of a "reform Treaty" amending the existing EU Treaties. The UK and Poland have confirmed their "opt-out" from full, binding application of the Charter of Fundamental Rights of the EU.

International: Inditex signs agreement on supply chain labour standards

On 4 October 2007, Inditex, the world's second-largest clothes retailer (through brands such as Zara), signed an innovative agreement committing it to guaranteeing workers' rights throughout its supply chain worldwide.

Germany: Changes in care scheme will give employees right to time off

After some 18 months of intense debate, in October 2007 the cabinet agreed changes in the financing of the state scheme for long-term dependant care (Pflegeversicherung), which will raise contribution rates, improve and reorganise care provision, and grant employees statutory time-off rights, including six months' unpaid leave to look after a dependant.

Ireland: Strike averted at ESB

In last-minute talks on 26 October 2007, a deal was reached to prevent a strike at Ireland's largest power station. The dispute related to the unpaid wages and future employment of 200 Polish workers employed by a subcontractor.

Italy: Vodafone workers strike over outsourcing

Trade unions at the Italian subsidiary of Vodafone, the UK-based telecommunications group, called strikes during October 2007 in protest against a management decision to outsource the work of some 900 employees.

Poland: Teleworking rules come into force

Legislation clarifying the legal situation of teleworkers took effect in October 2007. It covers the definition of teleworking, the rights and duties of employees, and employers' responsibilities for health and safety and the equipment used.

In October 2007, the European Commission submitted a revised version of its draft Directive on supplementary pension rights. In line with the wishes of the European parliament and council, the new proposal drops any attempt to improve the transferability of occupational pension rights when workers move within and between member states. Instead, it focuses only on the acquisition of pension rights, the preservation of dormant rights and enhanced information for workers.

EU: Commission questions exclusion of maritime workers from employment law Directives

Seafarers are currently not covered by some important EU employment law Directives, such as those on collective redundancies and transfers of undertakings, and are only partially covered by others. In October 2007, the European Commission launched a consultation exercise seeking views on whether or not these exclusions are still justified.

France: Employers seek ambitious reform of employment contracts

At the behest of the government, France's main trade union confederations and employers' organisations are engaged in major negotiations on labour market "modernisation", with the aim of reaching an agreement by the end of 2007. The talks are based on a document drawn up by the employers, which proposes a series of reforms to all stages of the employment relationship and to the unemployment insurance and jobseeking system. We examine the main proposals, which include a reform of employment contracts and new ways of terminating them.
