EU: Commission announces legislative plans for 2011
The European Commission's legislative plans for 2011 include:

  • renewed attempts to revise the Working Time Directive;
  • an initiative to improve the implementation of the Posted Workers Directive;
  • a draft Directive on work-related musculoskeletal disorders; and
  • consultations that may lead to draft Directives on paternity and carers' leave and environmental tobacco smoke at work.
France: Report finds new contract-termination procedure a success
An official report published in France in October 2010 finds that a new statutory procedure for terminating employment contracts by mutual consent, introduced in 2008 has proved popular and resulted in very little litigation.

EU EMPLOYMENT LAW PLANS FOR 2011
The European Commission has announced that in 2011 it will make another attempt to amend the Working Time Directive. Revision of this Directive has been one of the most intractable issues in EU employment law in recent years. Hostilities are likely to be renewed among governments, the European Parliament and the social partners over thorny topics such as the 48-hour week opt-out and the treatment of on-call time.

The Commission's 2011 programme also features a legislative initiative to improve the implementation of the Posted Workers Directive; a draft Directive on work-related musculoskeletal disorders; and consultations that may lead to draft legislation on paternity and carers' leave, second-hand tobacco smoke at work and company restructuring.
